Terms of Service

Terms and conditions governing your use of TravelPRNews.com and its travel press release distribution and related service(s) (collectively, the “Service”):

1. Use

  1. Submitted PR Materials; Editorial Guidelines
    You are responsible for the content, accuracy, and legality of all press releases and other PR information submitted by you to EPR Network, LLC dba TravelPRNews.com (“TravelPRNews.com”) or entered into the Service (the “Submitted PR Materials”). Because of the volume of information and the number of travel press releases submitted to TravelPRNews.com, TravelPRNews.com cannot be responsible for verifying facts contained in Submitted PR Materials. All Submitted PR Materials must follow TravelPRNews.com’s editorial guidelines (as posted on the website and subject to change at any time at TravelPRNews.com’s sole discretion).

License & Enforcement Authorization (for Submitted PR Materials).
By submitting PR materials to TravelPRNews.com, you grant EPR Network, LLC a worldwide, royalty-free, transferable license to reproduce, distribute, display, publish, archive, store, and otherwise use such PR materials in connection with the Service (including on websites, feeds, and archives). You further authorize EPR Network, LLC to act as your authorized agent for purposes of protecting and enforcing copyrights in the Submitted PR Materials, including (without limitation) the right to send cease-and-desist letters, submit DMCA notices, and pursue legal or administrative remedies to prevent unauthorized copying or misuse.

  1. Editorial Control; Ownership of Editorial Enhancements
    TravelPRNews.com reserves the right (i) to reject or edit Submitted PR Materials, provided that substantive edits to Submitted PR Materials will not be made without your prior consent; and (ii) to remove any press release from its website, pull any press release from distribution, or deny approval to any press release. TravelPRNews.com can only remove Submitted PR Materials from its own site; it makes no representation or warranty regarding removal from third-party sites not affiliated with or controlled by TravelPRNews.com or EPR Network, LLC.

TravelPRNews.com retains all rights, title, and interest in any original editorial enhancements it creates in connection with Submitted PR Materials or its own original reporting (collectively, “TravelPRNews Editorial Content”), including but not limited to summaries/abstracts, headlines, FAQs, curated links, editorial picks, formatting, selection/coordination/arrangement of materials, page design and layout. These enhancements and original reporting are copyrighted works of EPR Network, LLC. To the extent applicable outside the U.S., TravelPRNews.com also asserts rights in its selection and arrangement of content and data compilations under applicable laws.

  1. Publication Timing
    TravelPRNews.com endeavors to disseminate Submitted PR Materials promptly and accurately. Any inadvertent errors by TravelPRNews.com will be corrected promptly upon discovery, without additional charge, and such obligation to correct shall constitute the sole liability of TravelPRNews.com in this regard. If Submitted PR Material is not published on and distributed via TravelPRNews.com within 30 days of the earlier of (i) the date on which you enter such material or (ii) payment for the Service (even if you have not yet entered the material) for reasons other than a delay caused solely by TravelPRNews.com, then TravelPRNews.com’s service to you concerning such material and/or payment shall be considered complete, and TravelPRNews.com shall have no further obligation to you regarding such material or payment.
  2. Contact Details
    All Submitted PR Materials transmitted by TravelPRNews.com must contain a user-supplied contact name, phone number, and email address that may be verified by TravelPRNews.com.
  3. Distribution; No Placement Guarantee; Optional Exclusivity
    TravelPRNews.com does not guarantee specific placement or third-party pickup of any travel press release. It will deliver content via online distribution methods to make such content available to third parties who discover it across the Internet, intended or unintended. Where PR materials are submitted on an exclusive basis, you warrant that you have not provided, and will not provide, the same PR materials to any other newswire or distribution service until after TravelPRNews.com has published them.
  4. Acceptable Use; Automated Access
    You agree to use the Service only for its intended purpose and not for any illicit purposes including, but not limited to, reverse engineering of the site and/or its processes or inclusion of such processes in a derivative service. You shall not query, scrape, harvest, crawl, or access any TravelPRNews.com systems or content by automated means (including bots, spiders, or similar tools) without prior written consent from TravelPRNews.com or EPR Network, LLC. Systematic retrieval of data or content to create or compile, directly or indirectly, a collection, database, or directory without prior written permission is prohibited.
  5. Use of Site Content; Republishing Restrictions
    Except for Submitted PR Materials as distributed through the Service, you may not copy, republish, mirror, or otherwise reproduce TravelPRNews Editorial Content (including summaries, headlines, curated links, FAQs, formatting, selection/coordination/arrangement, or original reporting) without prior written permission from TravelPRNews.com. Limited quotation for news reporting/criticism is permitted with clear attribution and a conspicuous link to the original TravelPRNews.com page. Any other reuse requires prior written consent.

2. Suspension; Termination

TravelPRNews.com may suspend or terminate your account, wherever applicable, at any time in its sole discretion. If your account becomes delinquent or you breach any material term or condition herein, then, in addition to any other rights or remedies, TravelPRNews.com reserves the right to suspend your access to the Service, without liability to you.

3. Billing

  1. Fees
    You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect when a fee or charge is due and payable. All payment obligations are non-cancelable and all amounts paid are non-refundable. TravelPRNews.com reserves the right to modify its fees and charges and to introduce new charges at any time.
  2. Taxes
    All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes based solely on TravelPRNews.com’s income. If you believe your bill is incorrect, you must contact us in writing within 60 days at info@travelprnews.com.
  3. Payment Processing
    TravelPRNews.com collects no billing information on its own. TravelPRNews.com utilizes third-party billing and payment processors (e.g., PayPal or 2Checkout) to accept payments. You agree to update this information within 30 days of any change. If the contact or billing information you have provided is false or fraudulent, TravelPRNews.com reserves the right to terminate your access to the Service in addition to any other legal remedies.
  4. Currency
    Unless otherwise agreed to by TravelPRNews.com, amounts will be billed in U.S. dollars.

4. Warranties; Limitation of Liability

  1. Your Warranties
    You represent and warrant to TravelPRNews.com that: (i) you have the right to deliver the Submitted PR Materials to TravelPRNews.com; (ii) you will comply with all applicable laws, rules, and regulations (including COPPA and anti-spam laws); (iii) Submitted PR Materials will not contain any content that is obscene, defamatory, false or misleading, or that violates any copyright, privacy/publicity right, or other rights of any person; (iv) Submitted PR Materials will not contain malicious code; and (v) you are the copyright owner of the Submitted PR Materials or have obtained all necessary permissions, licenses, or rights to authorize TravelPRNews.com to use, distribute, and enforce rights in such materials as described in these Terms, including granting TravelPRNews.com authority to pursue enforcement actions and content removal requests with third parties and platforms.
  2. Disclaimers
    TRAVELPRNEWS.COM MAKES NO WARRANTIES, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND TITLE, AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE), REGARDING THE SERVICE. TRAVELPRNEWS.COM DOES NOT WARRANT OR REPRESENT THAT THE SERVICE WILL BE FREE FROM ERRORS, INCLUDING OMISSIONS, INTERRUPTIONS, DELAYS, LOSSES, OR DEFECTS, WHETHER HUMAN OR MECHANICAL.
  3. Limitation of Liability
    TRAVELPRNEWS.COM’S ENTIRE LIABILITY FOR DAMAGES FOR ANY CLAIMS ARISING UNDER OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION, WHETHER IN CONTRACT OR IN TORT (INCLUDING WITHOUT LIMITATION, BREACH OF WARRANTY AND NEGLIGENCE CLAIMS), SHALL BE LIMITED TO YOUR ACTUAL DIRECT DAMAGES, NOT TO EXCEED THE AMOUNTS ACTUALLY PAID BY YOU FOR YOUR USE OF THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE MONTH IN WHICH THE CAUSE OF ACTION AROSE. IN NO EVENT SHALL TRAVELPRNEWS.COM HAVE ANY LIABILITY TO YOU FOR ANY CLAIMS OR DEMANDS OF THIRD PARTIES OR ANY LOST PROFITS, LOSS OF BUSINESS, LOSS OF USE, LOST SAVINGS, OR OTHER CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, EXEMPLARY, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5. Indemnification

  1. By TravelPRNews.com
    TravelPRNews.com will indemnify (“Indemnitor”) and hold you (“Indemnitee”) harmless against any claim or demand by a third party, including reasonable attorneys’ fees, alleging that the Service infringes any intellectual property right of a third party under U.S. law. This indemnification does not cover claims arising from: (i) modifications to the Service by anyone other than TravelPRNews.com or its authorized agents/contractors; (ii) use of the Service by you in combination with other software or equipment not authorized by TravelPRNews.com where the Service, if not so used, would not be infringing; or (iii) your failure to use the Service in accordance with these Terms.
  2. By You
    You shall indemnify (“Indemnitor”) and hold harmless TravelPRNews.com (“Indemnitee”), its affiliates, and its third-party vendors (including distributors) from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to any breach by you of any representations and/or warranties contained herein or otherwise arising out of or relating to the Submitted PR Materials.
  3. Conditions
    Indemnification is conditioned upon: (i) the Indemnitee promptly notifying the Indemnitor of any claim; (ii) the Indemnitor having sole control of the defense and all related settlement negotiations; and (iii) the Indemnitee cooperating, at the Indemnitor’s expense, in the defense and furnishing the Indemnitor with all related evidence in its control.
  4. Infringement Options
    If a claim regarding the Service and alleging infringement is brought or is likely, in TravelPRNews.com’s sole opinion, to be brought, TravelPRNews.com may, at its sole option and expense: (i) obtain the right for you to continue using the Service; (ii) replace or modify the Service so that it becomes non-infringing; or (iii) upon notice to you, terminate your use of the Service or any portion thereof, provided that EPR Network, LLC promptly refunds to you the prorated portion of any pre-paid fees paid hereunder.

6. Miscellaneous

  1. Facilities
    TravelPRNews.com facilities are governed by federal and state regulations.
  2. Intellectual Property
    EPR Network and TravelPRNews.com are trademarks or registered trademarks of EPR Network, LLC, and no right or license is granted to use them. Certain content available through and used to operate the Service is protected by copyright, trademark, patent, or other proprietary rights of TravelPRNews.com, EPR Network, LLC, and its affiliates, licensors, and/or service providers. You shall not (i) use any of the trademarks, service marks, logos, or other content accessible through the Service other than as set forth herein or as approved by TravelPRNews.com; or (ii) modify, alter, or deface any of the trademarks, service marks, or other intellectual property made available by TravelPRNews.com in connection with the Service. All rights not expressly granted are reserved by EPR Network, LLC.

You acknowledge that TravelPRNews.com may rely on the licenses and authorizations granted in these Terms to enforce copyrights and related rights in both its own editorial content and in Submitted PR Materials. Such enforcement rights extend to any unauthorized reproduction, scraping, automated harvesting, or republishing of TravelPRNews.com’s site design, database compilations, or content, whether in whole or in part.

  1. Publicity/Conduct
    You shall not hold yourself out as sponsored by, affiliated with, or endorsed by TravelPRNews.com or its affiliates. You agree not to (i) defame or disparage TravelPRNews.com, its marks, or the Service; or (ii) adapt, translate, modify, decompile, disassemble, or reverse engineer the Service or any software used in connection with the Service.
  2. Communications
    You consent to receive communications from TravelPRNews.com electronically by email to the email address you provided in connection with your use of the Service. You also consent to receive communications by telephone or by postal mail to the postal address you provided. You may change the email or postal address to which TravelPRNews.com sends communications by notifying TravelPRNews.com in writing at info@travelprnews.com.
  3. Binding Effect
    By registering for the Service or submitting PR materials, you agree to be bound by these Terms. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. Should you violate these Terms or any other rights of TravelPRNews.com, TravelPRNews.com reserves the right to pursue any and all legal and equitable remedies, including, without limitation, terminating any and all user accounts.
  4. Compliance
    You are responsible for all activity occurring under your account and during the usage of the Service and shall abide by all applicable local, state, national, and foreign laws, treaties, and regulations in connection with your use of the Service. Your obligations shall be binding on your heirs, successors, and assigns.
  5. Changes
    TravelPRNews.com reserves the right to modify these Terms or its policies relating to the Service at any time, effective upon posting of an updated version on the Service. You are responsible for regularly reviewing these Terms. Continued use of the Service after any such changes constitutes your consent to such changes.
  6. Relationship
    You acknowledge and agree that you and TravelPRNews.com are independent contractors. Nothing herein shall be construed to create a partnership, joint venture, agency, or employment relationship. Neither party has authority to enter into agreements on behalf of the other.
  7. Governing Law; Venue
    This Agreement shall be governed by and construed under the laws of the State of California, exclusive of its conflict-of-laws provisions. Any suit hereunder will be brought in the federal or state courts located in California, and you submit to the personal jurisdiction thereof. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement.

7. Copyright Policy & DMCA (17 U.S.C. § 512)

TravelPRNews.com respects the intellectual property rights of others and expects users to do the same. It is our policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (“DMCA”) and to terminate, in appropriate circumstances, repeat infringers.

  1. Submitting a DMCA Notice
    If you believe that material available on or through the Service infringes your copyright, please send a written DMCA notice to our designated agent (contact below) that includes:
  1. Your physical or electronic signature; 
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list); 
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material; 
  4. Your contact information (name, address, telephone, and email); 
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and 
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner. 
  7. Counter-Notification
    If you believe your material was removed or disabled by mistake or misidentification, you may send a valid counter-notification to the designated agent that includes the information required by 17 U.S.C. § 512(g).
